The learned counsel for the petitioners submits that the petitioners are arraigned as Accused Nos.2 and 3 in S.C.No.205 of 2024, on the file of the District and Sessions Court, Chittoor District. 2. It is submitted that the petitioners cannot be charged with an offence under Sections 302 and 304(B) of the IPC. As per the confession statement of Accused No.1, the petitioners were sleeping on the terrace on 21.11.2023 when the alleged incident took place. The issue of whether the petitioners are involved in the matter is to be dealt with by the Sessions Court handling the case. The quash 0quash petition is disposed off, leaving it open for the petitioners to raise all these grounds before the District and Sessions Court, Chittoor District, when SC No.205 of 2024 is taken up for trial. 3. Accordingly, the Criminal Petition is disposed off.
