GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: 2 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "…..to issue an appropriate writ, order or direction, more in the nature of Writ of mandamus declaring the action of the respondents in trying to shift the construction of Village Secretariat building from West Kattakindapalli village to which sanction was made by the 3rd respondent in its proceedings Rc.No.T4/PRID KDK/MGNREGS/RAS.VS/2019-20 dated 05.03.2020 and proposing to building village secretariat building at Cheruvu Poramboke site situated in Dodda Venkatayapalli village, acting upon the dictates of some vested interests, as being illegal, arbitrary and is in violation of Articles 14 and 21 of the Constitution of India, and pass such other order or orders….." 2. Precisely, the Writ Petition is filed seeking a direction to the respondents not to shift the Village Secretariat building from the petitioners‟ village to Dodda Venkatayapalli village. 3. Learned Government Pleader has furnished proceedings addressed by the Executive Engineer, PRI Division, Kandukur, Prakasam District, to the office of the Government Pleader for Panchayat Raj & Rural Development Department, High Court of Andhra Pradesh, vide Rc.No.A2/Court Cases/2024, dated 24.12.2024. 4. As seen from the above proceedings, it transpires that the Government has issued instructions not to take up the building works which were being at „not started‟ stage and „below basement level‟ stage and accordingly, the Village Secretariat building construction work 3 in West Kattakindapalli Gram Panchayat has been stopped by the Panchayat Raj Engineering Department. 5. The Government of Andhra Pradesh has not undertaken any building constructions work “not started and before basement level” stage. If it is the decision of the Government not to start new building constructions no direction is required to be issued to the respondents as prayed by the writ petitioners. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
