Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 338 of 2025 Petitioner :- Roop Chand Respondent :- State Of U.P. Thru. Secy. Food And Civil Supplies Lko. And Others Counsel for Petitioner :- Rajesh Kumar Pathak Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Attau Rahman Masoodi,J. Hon'ble Rajeev Singh,J. Heard learned counsel for the petitioner and learned Standing Counsel for the State. There is absolutely no material placed on record to show that the fair price shop in question has been constructed without passing a resolution by Gram Panchayat except a bald averment. Learned Standing Counsel for the State on the basis of instructions has stated that a resolution of the Gram Panchayat was passed on 23.12.2024, based on which, the construction of Annapurna Bhawan has commenced and progressed considerably. Once the decision of Gram Panchayat based on a resolution is being executed, there is no reason for this Court to interfere in the execution of such a decision taken by the Gram Panchayat. The writ petition due to the lack of adequate material and cogent submissions lacks merit, therefore, the same is hereby, rejected. (Rajeev Singh,J.) (Attau Rahman Masoodi,J.)
