Neutral Citation No. - 2025:AHC-LKO:19543 Court No. - 8 Case :- WRIT - C No. - 3348 of 2025 Petitioner :- Babu Ram Education Society, Mainpuri Thru. Secretary / Authorized Signatory, Shri Dinesh Chandra Respondent :- State Of U.P. Thru. Addl. Chief / Prin. Secy., Deptt. Of Technical Education, Lko. And Others Counsel for Petitioner :- Rajat Rajan Singh,Kavya Rastogi Counsel for Respondent :- C.S.C.,Ravi Singh Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of the respondents No.1 and 3 has been accepted by the office of the Chief Standing Counsel. Shri Ravi Singh, learned counsel has accepted notice on behalf of the respondent No.2. By means of the instant petition, the petitioner prays for the relief No.1, which reads as under:-
"(i) To issue a writ, order or direction in the nature of mandamus commanding the Pharmacy Council of India (respondent No.2) to consider and decide the Appeal/compliance submitted by the Petitioner for processing th application for Diploma in Pharmacy Course with 60 seats for academic session 2025-26." At the outset, learned counsel for the petitioner submits that he does not wish to press the relief No.2 inasmuch as it is clearly indicated that the application fee once paid is not refundable and for the said reason the petitioner confines his prayer only in respect to the relief No.1 as reproduced above. The submission of the learned counsel for the petitioner is that the petitioner had applied for the approval from the respondent No.2, however, at the time of uploading the documents, the consent of the affiliation document could not be uploaded, as a result, the application of the petitioner came to be rejected, a copy of which has been brought on record as Annexure No.5. However, there was instructions by the respondent No.2 that those Institutions whose applications have been rejected/they could file their appeals against the rejection or to upload certain documents which were wanting by 15.03.2025, however, the same could not be done. It is urged that the petitioner taking cue from the aforesaid had uploaded the consent of the affiliation which was available with the petitioner, however, till date, no decision has been taken by
the respondent No.2.
Considering the facts and circumstances and the issue that a decision is yet to be taken by the respondent No.2, at this stage, this Court is of the opinion that no gainful purpose will be served in keeping the aforesaid petition pending rather ends of justice can be served by directing the respondent No.2 to consider and decide the case of the petitioner preferably within a period of two weeks from the date, a certified copy of this
order is placed before the respondent No.2. It is made clear that the Court has not examined the plea of either of the parties on merits and the respondent No.2 shall consider and decide the case of the petitioner strictly in accordance with law and intimate the decision so taken to the petitioner. With the aforesaid, the petition is disposed of.
