Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.69of 2025of Dargamitta Police Station, SPSR Nellore District, registered for the alleged offences under Sections 420 and 506 of the Indian Penal Code, 1860. 3. It is alleged in the complaint that the petitioner collected money from the 2nd respondent on the promise to provide employment, however he could not do so. The learned counsel for the petitioner submits that there are no specific allegations against petitioner and was falsely implicated in the complaint. 4. The learned counsel submits that the offences alleged against the petitioners are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Dargamitta Police Station, Sri Potti Sriramulu Nellore District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, -3- CRL.P. No.3457of 2025 insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.69 of 2025. 6. Accordingly, the criminal petition is disposed off. 7.
