Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 3. By this petition, the petitioner has prayed for the following relief:- "Issue a writ, order or direction in the nature of Mandamus commanding the Opposite Party No.2 to consider and grant the Special ACP on completion of 24 years satisfactory services (Pay Band 4 Rs. 37400-67000 grade pay Rs. 8900/-) to the petitioner in the light of the Government order dated 26.02.2015 and after granting said benefit also pay salary of arrears with all service consequential benefits." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner may be directed to be decided by respondent no.2. Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.2 i.e. Director General, Medical and Health, U.P., Lucknow within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.2 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order. It is made clear that the representation shall be decided in light of the order dated 26.02.2015 in case there is no legal impediment.
