By way of this petition, the petitioner has prayed for following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire record the case of the petitioner, in the interest of justice. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to provide recounting for the post of Zila Panchayat at Zila 3 Panchayat area No. 08 Tushar Block and Janpad Panchayat Jaijaipur, District Sakti (C.G.) at the earliest, in the interest of justice. 10.3 That, the Hon'ble Court be further pleased to grant such other relief as may be deemed fit and proper in the interest of justice..” 2. Learned counsel for the petitioner submits that though he has filed this petition but upon query it has been fairly submitted that the remedy lies before the competent authority while filing of Election Petition hence the petitioner is seeking liberty of this Court to withdraw this petition and to file a fresh duly constituted Election Petition before the competent authority. 3. No objection has been raised from other side. 4. Accordingly, the prayer is allowed and the instant petition is dismissed as withdrawn, with liberty to file a fresh duly constituted petition.
