For Objector : Mr. V.R. Tiwari, Senior Advocate along with Atul Kesharwani, Advocate. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 19.03.2025 1. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 15/2025 registered at Police Station – Mandir Hasaud, District - Raipur (C.G.) for the offence punishable under Sections 3(5), 318(4), 336(3), 338 and 340(2) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’) 2. The prosecution story, in brief, is that Smt. Pravin Agrawal, the complainant, filed FIR No. 15/2025 at the Madir Hasaud Police Station PREETI KUMARI Digitally signed by PREETI KUMARI 2 against three other accused: Smt. Dewantin, Ruknuddin Khan, and Satish Sinha. The complaint alleged that these three accused falsely executed a Sale Deed dated 20.12.2024. The only allegation against the present applicant is that they disclosed knowledge of the allegedly forged and registered Sale Deed. Consequently, the crime was registered only against the aforementioned three accused. Following this, Vikas, the complainant's husband, pressured the applicant to testify as a witness against the three accused. However, the applicant refused. Subsequently, Vikas, accompanied by the police, threatened the applicant with prosecution in connection with this crime. The applicant now fears arrest and has filed an application for anticipatory bail. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated due to previous enmity . He further submits that the only allegation against the present applicant is that they disclosed knowledge of the allegedly forged and registered Sale Deed, further the applicant has no previous criminal antecedents. Therefore, he prays grant of bail to the applicant. 4. On the other hand, the learned State counsel as well as Objector opposes the anticipatory bail application of the applicant. They further submits the applicant has cheated the complainant by creating forged documents including Aadhar Car, Pan card, Rin pustika and bank account. They also submits that from the documents and allegation in the FIR, it is clearly shown that the intention of the applicant and other co-accused persons was to cheat the complainant since inception. Hence, he is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity 3 of allegation leveled against the applicant and the fact that the only allegation against the present applicant is that they disclosed knowledge of the allegedly forged and registered Sale Deed, further the applicant has no previous criminal antecedents, hence, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7.
