KRISHNAKUMAR ORDER 08.05.2025 Mr. Leo Rommel, learned counsel, appears for the appellant; and Mr. L. Seityandra, learned counsel, appears for the respondents. Temporary injunction was granted in favour of the appellant/plaintiff vide order dated 21.05.2022 passed by the Civil Judge Junior Division, Thoubal in Judl. Misc. Case No. 63 of 2021 (Ref: OS No. 28 of 2021). Challenging the aforesaid order, the respondents/defendants filed Misc. Civil Appeal No. 6 of 2022 before the District Judge, Thoubal, and by order dated 03.06.2022 passed in the Misc. Civil Appeal No. 6 of 2022, the Trial Court stayed the operation of the temporary injunction order dated 21.05.2022. Aggrieved thereby, the present appeal has been filed before this Court. When the matter was heard on 10.04.2025, learned counsel for the respondents placed downloaded copy of the case status of Misc. Page 2 of 2022 from the official website of the District & Sessions Court, Thoubal, from which it is seen that the Misc. Civil Appeal No. 6 of 2022 was disposed of on 12.01.2024 and therefore, learned counsel for the respondents stated that the present appeal may be closed as infructuous. On the other hand, learned counsel appearing for the appellant, relying upon the original case record of Misc. Civil Appeal No. 6 of 2022, submitted that the said Misc. Civil Appeal No. 6 of 2022 is still pending before the District Judge, Thoubal. Therefore, a direction was given to the Registry to call for status report from the Court of District Judge, Thoubal in this regard. Pursuant to the order of this Court, the status report has been filed by the District Judge, Thoubal, stating that by mistake, the case was wrongly disposed of on 12.01.2024 and the said mistake was rectified and restored on 02.05.2025 and the same is still running and not disposed of. According to the learned counsel for the respondents, the appellate court stayed the operation of the injunction order and the same is in force till today. In these circumstances, learned counsel for the parties seeks for a direction to dispose of the aforesaid Misc. Civil Appeal No. 2022, which is pending before the District Judge, Thoubal within a stipulated time. Upon considering the submission made by the parties and also perused the report submitted by the District & Sessions Court, Thoubal, in the interest of justice, this Court is inclined to direct the District Judge, Thoubal, to dispose of the aforesaid Misc. Civil Appeal No. 6 of 2022 as early as possible, MAF No. 1 of 2022; & Ors. Page 3 preferably within a period of eight weeks from the date of receipt of a copy of this order. Both the parties undertake before this Court that they shall cooperate for early disposal of the said appeal.
