The learned counsel for the petitioner would submit that the petitioner is the residence of TVS Tollgate, Pudukottai Main Road, Trichy. There is a village temple, situated in his native village, namely, Sri Sappani Karuppanna Swami temple. During Sivarathiri festival and other important days, all the families used to worship the god. While so, there is a misunderstanding between the respondents 3 to 5 and the petitioner due to inter-cast marriage of the petitioner. Hence, they are restraining the petitioner from entering and worshipping the god of the temple. On 07.03.2025, at about 7.00 p.m., when the petitioner, along with his family _____________ Page No. 2 of 6 https://www.mhc.tn.gov.in/judis W.P(MD) NO.9722 of 2025 members, went to the temple, the respondents 3 to 5 restrained them from worshipping the god and also they threatened them with dire consequences. Hence, he lodged a complaint before the second respondent on 07.03.2025, but no action was taken. Again, he sent a detailed representation on 11.03.2025, but the same also has not been considered. Therefore, he filed this petition. 3. The learned Additional Public Prosecutor (Crl side) for the respondents 1 and 2 would submit hat the petitioner did not go to the temple for the past 10 years, however, he sent a representation alleging that the private respondents restraining him from worshipping the god. On enquiry, they came to know that no such occurrence was happened and there is no objection from the villagers including from the private respondents for worshipping the god by the petitioner. Therefore, there is no cause of action for this petition. However, if the petitioner wants police protection, they will provide the same in accordance with law. 4. Considering the prayer sought for in this petition, this Court, without issuing notice to the private respondents, is inclined to pass orders. _____________ Page No. 3 of 6 https://www.mhc.tn.gov.in/judis W.P(MD) NO.9722 of 2025 5. According to the petitioner, the private respondents/respondents 3 to 5 restrained the petitioner from worshipping the god namely, Sri Sappani Karuppanna Swami temple and thereby, he sent a representation, dated 11.03.2025, but the same has not been considered. The second respondent also admitted the receipt of the representation and there is no excommunication as alleged by the petitioner and also no villagers are restraining the petitioner from worshipping the god. Further, they are ready to give police protection. 6. Therefore, recording the abovesaid submission of the learned Additional Public Prosecutor (Crl side). this Court directs the second respondent to provide adequate police protection to the petitioner for peaceful worship. 7.
