Neutral Citation No. - 2025:AHC-LKO:19334 Court No. - 16 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1005 of 2025 Applicant :- Anantram Opposite Party :- Medhi Lal Posted Consolidation Officer Milkipur District Faizabad Counsel for Applicant :- Richa Tiwari,Sandeep Tiwari Hon'ble Ashwani Kumar Mishra,J. This contempt petition has been filed alleging disobedience of the order dated 05.05.2023 passed by this Court in Matter Under Article 227 No. 2299 of 2023, whereby the objection of the applicant/petitioner under Section 9A(2) of the U.P. Consolidation of Holdings Act, 1953 was directed to be decided within a period of one year. It is alleged that the aforesaid order has been served upon the opposite parties but despite service of order the proceedings have not been concluded. I have perused the order sheet and for almost 90% of the dates fixed in the case the lawyers were on strike as a result of which the proceedings had to be adjourned. In a scenario of this kind it cannot be said that the Presiding Officer acted in disregard of the direction issued by this Court in the order dated 05.05.2023. Law is settled that contempt would lie only if the action of contemnor is shown to be deliberate or wilful. In the facts of the case, the action of the opposite party cannot be said to be wilful or deliberate in violating the directions issued by the writ court. The contempt petition fails and is, accordingly, dismissed. Order Date :- 7.4.2025 J. K. Dinkar Digitally signed by :- JESHU KUMAR DINKAR High Court of Judicature at Allahabad, Lucknow Bench
