JUSTICE DEVASHIS BARUAH ORDER 30.05.2025 Heard Mr. S Chauhan, the learned counsel for the petitioner who submits that pursuant to the order dated 11.04.2025, the Assistant Settlement Officer Phuloni Circle had already been examined as a Court-Witness, therefore, nothing further remains in the instant petition. He, however, submits that the petitioner should be granted an opportunity to cross examine the Court-Witness, if any statements are made which goes against the interest of the petitioner. 2. It is the opinion of this Court that if the petitioner wants to cross examine the Court-Witness, an application is required to be filed before the said Court. 3. Taking into the account that the statement of the Assistant Settlement Officer Phuloni Circle had already been recorded, nothing further remains in the instant proceedings. Be that as it may, the petitioner would be at liberty to file an application for cross examination of the said Court-Witness.
