The petitioner has sought a writ of Mandamus to the opposite party Nos.1 to 4 for terminating the services of opposite party No.5 and for recovery of salary paid to her on the ground that she had obtained appointment on the basis of forged certificate. A letter dated 28.10.2021 has been annexed as part of annexure No.1 to the Writ Petition, which is by the Executive Engineer, Minor Irrigation Khand, Ayodhya to the Superintending Engineer, Minor Irrigation Circle, Gorakhpur, which is being relied by the petitioner to contend that the qualification was not as per law. There is another letter dated 24.01.2022 sent by the Superintending Engineer, Minor Irrigation Circle, Gorakhpur to Chief Engineer, Minor Irrigation Department, Uttar Pradesh, Lucknow, according to which, the learned Standing Counsel says that on inquiry, it was found that the committee which had selected the opposite party No.5 has found her certificate to be adequate, meeting the requirements of the qualification laid down for such appointment to the post of Stenographer. The opposite party No.5 was appointed in 2006 and as per the said letter dated 24.01.2022, she had acquired CCC Certificate in 2014 and on verification by the Executive Engineer on 19.01.2022, the said certificate was found to be genuine. Learned Standing Counsel has written instructions to the effect that thereafter the State Government has got the matter inquired and as per the letter dated 16.11.2022, no irregularity was found in the qualification of the opposite party No.5 so as to warrant any action against her. Be that as it may. Learned Standing Counsel has placed before us a letter dated 16.11.2022 issued by the State Government to the Chief Engineer, Minor Irrigation Department, Lucknow, which is taken on record. Let a copy of the said letter be furnished by the opposite party No.2 to the petitioner within one week. Thereafter, if there is a cause, the petitioner may avail remedies as may be prescribed in law, provided she has locus standi. The Writ Petition stands disposed of. (Om Prakash Shukla,J.)
