Notice on behalf of the respondents No.1 and 2 has been accepted by the office of the Chief Standing Counsel, Shri Varun Pandey appearing for the respondent No.3. Counsel for the petitioners submits that the petitioners have applied for the affiliation, for which, they had submitted their Bank Guarantees, which on account of technical reasons were not accepted. This matter of affiliation and deposit of bank guarantee was under litigation and the Government of India issued a notification on 28 August 2024, in terms whereof, a minutes of meeting was drawn that in order to prevent further litigation, the State Directorate may issue a notification permitting the remaining 710 ITIs to deposit fresh Bank Guarantees within a period of four to eight weeks from the date of issuance of the minutes of the meeting. Considering the nature of the controversy which involves factual determination, accordingly, in the given facts and circumstances, this Court, without entering into the merits, is of the opinion that ends of justice would be served by directing the respondent No.2 to consider and decide the pending representation of the petitioners, a copy of which has been brought on record as Annexure No.13 (if already not decided) by a reasoned and speaking order and inform the petitioners regarding its outcome. It is made clear that the Court has not examined the case of the petitioners on merits and it will be for the authority concerned to take an appropriate decision in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 4.6.2025 Harshita Digitally signed by :- HARSHITA High Court of Judicature at Allahabad, Lucknow Bench
