ORAL ORDER
Heard the learned counsel Sri.S.Thyagaraja for petitioner Nos.1, 3 and 6.

Learned counsel Sri.S.Thyagaraja would submit that the prayers (b) to (h) would no more survive for
consideration and he would submit that the prayer (a) only would survive for consideration at present.

Learned counsel for the petitioners would submit that the petitioners were kept under suspension on 01.09.2018 and subsequently suspension was revoked and they were deputed to various other institutions under
order dated 23.01.2020.
4. During the course of hearing, learned Additional Government Advocate made available the order dated

23.01.2020 under which petitioners are deputed to other institutions by revoking their suspension, which discloses that the Management had not obtained approval for suspension from the competent authority and respondent No.2 has held that suspension is illegal. In that view of the matter, petitioners seek salary for the period under which they were under suspension.

Learned counsel Sri.S.Thyagaraja would submit that when the suspension of the petitioners are declared or treated as illegal, the management would become liable to pay the salaries of the petitioners. Therefore, he submits that respondent Nos.4 and 5 be directed to pay the salary of the petitioners.
6. The petitioners have alternate remedy under Section 130 or 131 of the Karnataka Education Act, 1983. The petitioners have to make appropriate representation before the Competent Authority seeking salary for the period during which they were under suspension and it is

for the Competent Authority to take note of the petitioners’ contention and pass appropriate order.
7. In that view of the matter, writ petition stands
disposed of with liberty to the petitioners to make appropriate representation before the Competent Authority or before the Authorities under 1983 Act.
