ORDER:
The instant Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, by the Petitioner/Accused No.1, to quash the proceedings against him in F.I.R.No.196 of 2021 of Vatsavai Police Station, Krishna District, for the offence punishable under Sections 452, 427, 324 and 506 read with 34 of the Indian Penal Code, 1860.

2. When the matter is taken up for hearing, Sri Ginjupalli Subbarao,
learned counsel for the Petitioners would submit that the offences alleged against the Petitioner are punishable with imprisonment not more than seven years and hence, the petition may be disposed of by giving protection to the Petitioner vide guidelines of the Hon’ble Apex Court in Arnesh Kumar v. State of Bihar1.
3. Learned Assistant Public Prosecutor, on instructions, would submit that the offences registered against the Petitioners are punishable with less than seven years period of imprisonment and necessary direction may be given to the concerned Station House Officer.
4. Considering the submissions, this criminal petition is disposed of with the following; a. Investigating Officer is directed to complete the investigation, and file a report in accordance with law, within a period of two months from the date of receipt of copy of this order. b. In the event of any coercive action sought to be taken against the Petitioner, concerned police authorities are
directed to scrupulously follow the procedure prescribed under Section 41-A Cr.P.C., and the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar’s case (supra).
Pending applications, if any, shall stands closed.
