Of U.P. Lko. And 6 Othe 21.12.2021, rs Counsel for Petitioner :- Hari Govind Dubey,Gyanendra Kumar Sahu,Radhey Govind Dubey,Ram Kedar Dubey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. The petitioner claims encroachment on his land by the Gram Pradhan, who is arrayed as opposite party No.6 and by the opposite party No.7, who is a private person. He places reliance upon a report dated 30.10.2019 submitted by the Revenue Inspector in proceedings under Section 24 of the Uttar Pradesh Revenue Code, 2006, which has been confirmed by the Sub- Divisional Magistrate, Akbarpur, Ambedkar Nagar on 21.12.2021, however, it has not been implemented as yet. Counsel for the Gram Sabha also relies upon the said report to submit that the said report is being implemented as regards the encroachment of Gram Sabha land/chak marg and the Gram Sabha was not a party in those proceedings. We cannot decide such a dispute. The petitioner should approach the Sub- Divisional Magistrate concerned, raising his grievance, who may get the facts verified and do the needful but only as per law and after hearing the Gram Sabha. If the petitioner is still aggrieved, he can avail the remedy as may be prescribed in law. 3. The writ petition is disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
