Heard learned counsel for applicant, learned A.G.A. for the State and peruse the material available on record. 2. At the very outset, learned counsel for applicant submits that the applicant does not wish to press the present application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 and the same may be dismissed as not pressed. He submits that one of the prayer made in the present application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 is with regard to the challenge to the entire proceedings under Section 138 of the Negotiable Instruments Act, 1881 and seeks liberty to file a fresh only with regard to the said prayer. 3. Accordingly, the present application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 is dismissed as not pressed with liberty as aforesaid. 4.
