2. This criminal revision is preferred against the judgment and order of conviction dated 06.03.2019 (Annexure A/1) passed by the learned Additional Sessions Judge, (F.T.C.), Kawardha, Distt. Kabirdham (C.G.) in criminal appeal No. 14/2018, whereby, affirming the
judgment and order of conviction dated 06.02.2018 (Annexure A/2) passed in Criminal Case No. 451/2009 by the Judicial Magistrate First Class, Kawardha Distt. Kabirdham (C.G.) whereby the sole applicant has been convicted and sentenced for the offence punishable under Section 138 of Negotiable Instruments Act, 1988 and sentenced him to undergo R.I. for 09 months and fine amount of Rs. 10,000/- and in default of payment of fine amount additional simple imprisonment for 3 months.
3. From the order sheet dated 11.01.2024, it is apparent that the sole applicant has died which has been informed to this Court by the counsel for the applicant. On the said date on the request of learned counsel for the applicant four weeks’ time was granted to take appropriate steps in this regard. Despite lapse of more than 1 and ½ year no application has been moved by the counsel for bringing the legal heirs of the deceased applicant.
4. In view of foregoing, this Court has no other option except to dismiss this criminal revision as abated.
5. Accordingly, this Criminal revision is dismissed as abated. Sd/-
