The wife and children of Late Susheel Kumar have filed this petition under Article 226 of the Constitution of India seeking the insurance amount under certain insurance policies issued by the opposite parties in favour of Late Susheel Kumar. Learned Counsel for the Insurance Company says that the wife, Keshana, was the nominee who pre-deceased the insured person. The petitioner no. 1, Smt. Archana, is another person claiming to be wife of Late Susheel. However, the petitioners' Counsel says that the nominee was the mother, who was incorrectly mentioned as the wife, it is the petitioner no. 1 who is the wife. These are not issues which can be seen under Article 226 of the Constitution of India. The petitioners will have to initiate proper proceedings before the competent forum or Court. With liberty aforesaid, we dispose of this writ petition.
