Neutral Citation No. - 2025:AHC-LKO:19728 Court No. - 3 Case :- WRIT - A No. - 3640 of 2025 Petitioner :- Sanjay Singh Respondent :- State Of U.P. Thru. Secy. Home U.P. Lko. And 6 Others Counsel for Petitioner :- Vinod Kumar Counsel for Respondent :- C.S.C. Hon'ble Rajesh Singh Chauhan,J. Heard Sri Vinod Kumar Guprta, learned counsel for the petitioner and Sri Nitin Mathur, learned Addl. C.S.C. for the State-respondents. In view of the proposed order notice to opposite parties no. 5,6 and 7 are hereby dispensed with. At the very outset learned counsel for the petitioner has submitted that the petitioner was appointed on the post of Security Guard through opposite party no. 6 i.e. Managing Director, Sunder Security Services, Manas Nagar, Dabha Semar, Cantt., Ayodhya but he has not been permitted to discharge his duties w.e.f. 1.9.2023 without any rhyme or reason. Attention has been drawn towards the guidelines being issued by the Ministry of Labour & Employment in relation to 'Protection of Interests of Employees through Outsourcing Agencies' dated 24.7.2023, a photocopy thereof has been provided and the same is taken on record, wherein it has been provided that the Labour Commissioners may redress the grievance of an employee. Be that as it may, since the petitioner is an outsourced employee, therefore, the relief prayed for in the writ petition may not be granted to the petitioner invoking the powers of Article 226 of the Constitution of India but for redressal of the grievance the petitioner may approach any competent authority of the Labour Department. In the present case the petitioner may approach the Deputy Labour Commissioner, opposite party no. 3, he may very well prefer a fresh representation to such authority and the authority concerned may consider and dispose of the grievance of the petitioner strictly in accordance with law. Therefore, without entering into the merits of the issue, the petitioner is permitted to move a fresh representation within 15 days before the opposite party no. 3 i.e. Deputy Labour Commissioner, District Ayodhya taking all his pleas and grounds and enclosing his earlier representations along with all
relevant documents. If such a representation is moved the opposite party concerned is directed to dispose of the representation of the petitioner with speaking and reasoned
order after affording an opportunity of hearing to the parties concerned, strictly in accordance with law expeditiously, say within a period of two months from the date of production of the certified copy of this order. The decision on the representation shall be communicated to the petitioner forthwith. Writ petition is finally disposed of. . [Rajesh Singh Chauhan, J.]
