Mr. V.S. Rawat, A.G.A. with Ms. Meenakshi Sharma, Brief Holder for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in Case Crime No. 144 of 2021, under Sections 420, 467, 468, 471, 120B IPC, Police Station Jhabreda, District Haridwar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, certain loan was disbursed in the name of the farmers, but the amount was deposited in the bank’s account. 4. Learned counsel for the applicant would submit that the applicant was Manager at the relevant point of time; he did not commit any offence; the scheme through which loan was distributed per se requires that the amount of loan should be distributed in the Escrow account for which collateral security was to be given by the Bank, which the Bank give. The applicant is not a beneficiary. The co-accused 2 have already been granted bail. He would refer to Annexure 1 to the bail application in support of his contention. 5. Learned State counsel would submit that as Bank Manager, the applicant was required to verify the position of the crops. He has not dispute the policy, by which the amount was deposited in the Escrow account. It is not stated on behalf of the State that the loan amount was deposited in any other account. 6 Having considered the entirety of facts, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
