Present petition has been filed with the following prayer: "(1) Issue a writ, order or direction in the nature of MANDAMUS commanding the opposite party 1 to 5 to ensure the removal of illegal encroachment/possession of opposite party no. 6 to 10 upon the public utility land i.e. Gata No.320 & 322 recorded as Khad Gaddha (खखाद गडखा), Gata No. 323 & 361 recorded as Chakmarg and Gata No.362 recorded as Harijan Abadi (हररिजन आबखादद) in the revenue records situated in village Shyampurwa H/o Nigoh, Tehsil- Payagpur, Police Station Visheshwarganj, District - Bahraich." 2. Learned Standing Counsel, based upon instructions, states that unauthorized constructions are non-existent now and only some part of Gata No.362 is encroached for which proceedings have been initiated. 3. In view thereof, present petition is disposed off with direction to conclude the proceedings initiated in respect of Gata No.362 expeditiously in accordance with law. 4. In case the petitioner is still aggrieved with regard to any encroachment, he may move an appropriate application under the U.P. Revenue Code which shall be considered in accordance with law.
