Heard Mr. Chandan Srivastava, Advocate holding brief of Mr. Vikas Srivastava, learned counsel for applicant, Mr. Bhupendra Veer Singh, learned counsel for opposite party no. 2, learned A.G.A. for the State and perused the material available on record. 3. At the very outset, Mr. Bhupendra Veer Singh, learned counsel for opposite party no. 2 has submitted that the applicant has disclosed the name of prosecutrix in the list of date and events and in paragraph no. 14 of the application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023. 4. At this stage, learned counsel for applicant submits that he may be permitted to withdraw this application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 as not pressed with liberty to file fresh one. 5. Learned counsel for applicant tendered his unconditional apology and prays for filing of fresh application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023. This Court considering the fact that inclusion of the name of the prosecutrix has been made inadvertently. His unconditional apology is accepted. 6. He further undertakes to delete the name of prosecutrix in the list of date & events and paragraph no. 14 of the said application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in all the copies even though the same have been supplied to the learned A.G.A. or filed in the registry. 7. In light of the above, this application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 is dismissed as not pressed with liberty as aforesaid. 8. Office is directed to furnish certified copy of the impugned orders and other relevant original documents to learned counsel for applicant in accordance with law. . (Alok Mathur, J.)
