Present petition is been filed for issuance of a writ of certiorari quashing order dated 31.1.2024 passed by respondent No.3, with a further writ of mandamus directing respondents to ensure payment of pension to the petitioner on the basis of his last pay drawn and release the arrears of pension. In compliance of order dated 5.4.2025 passed by this Court, Mr. Shrikant Darve, district Panchayat Raj Officer, Pratapgarh is present in court. He has stated that inadvertently, due to oversight, the impugned order dated 31/1/2024 was passed, ignoring the earlier order dated 6.10.2023 passed in Writ A No.3232 of 2022. It is submitted that he will not repeat this mistake in future. It is also informed by learned standing counsel that a fresh order dated 26.4.2025 has been passed in place of impugned order dated 31.1.2024 whereby the representation of the petitioner dated 30.10.2023 has been decided. In view of the above, the petitioner's counsel prays that he may be permitted to withdraw the petition with liberty to assail the fresh order dated 26.4.2025. The petition is accordingly dismissed as withdrawn with liberty to the petitioner to assail the new order dated 26.4.2025. Learned standing counsel shall serve a copy of the order dated 26.4.2025 to the petitioner's counsel, during course of day.
