Neutral Citation No. - 2025:AHC-LKO:18776 Court No. - 18 Case :- WRIT - A No. - 3611 of 2025 Petitioner :- Ajay Singh Pal Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And 2 Others Counsel for Petitioner :- Anupam Shukla,Bhuvanesh Kumar Bajpai Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents No. 1 to 3.
Learned counsel for the petitioner submits that, as per the impugned order dated 22.03.2025, the petitioner’s deputation has been canceled, and he has been transferred to District Maharajganj, which is far from his original district (Mool Janpad). He further submits that while the petitioner does not object to the cancellation of his deputation, similarly situated persons namely Prakash Swaroop Pandey, Amit Kumar Verma, Rajesh Kumar Yadav, Monu Singh, etc. have been repatriated to their original districts after the cancellation of their deputation. However, the petitioner, whose original district is Barabanki, has instead been sent to District Maharajganj. Learned Standing Counsel disputes this contention, and has submitted that the persons, named above, in Annexure-7 are not similarly situated and that their orders were passed under peculiar circumstances. It is further submitted that the petitioner’s deputation was canceled in the public interest and that he has been directed to report to the Incharge Deputation Cell in the office of DGP, U.P.
Lucknow. It is further contended that transfer is an incident of service, and since the petitioner has been transferred in the public interest, there is no illegality in the impugned order. Perusal of the record. Perusal of the transfer order indicates that it has been issued in the public interest. Transfer is an incident of service, and as a member of a police force, the petitioner cannot claim posting in a particular district except in peculiar circumstances. In view of the above, the petition is disposed of with liberty to the petitioner to submit a fresh representation before respondent No. 2 within a period of one week from today. Respondent No. 2 shall decide the said representation within a further period of four weeks' by passing a speaking and reasoned order.
