1. Applicants pray for grant of bail in their favour in connection with case FIR no.50/2020 under Section 18, 20 ULA(P) Act, 4, 5 Exp. Sub. Act, 7, 25 A. Act in police station Sopore and Challan presented and trial going on before the court of Nia Special Court at Sopore District Baramulla.
2. I have heard learned counsel for parties and considered the matter.
3. Prosecution story is that on 22nd March 2020 from reliable sources the police concerned received an information that some terrorists were in search of opportunity to attack policy/ security forces in Town Sopore. In view of security was beefed up. During checking, accused were apprehended. On search, one pistol with magazine and eight live cartridges of pistol were recovered from possession of one of the accused persons, namely, Ehtisham Farooq Malik while as three hand grenades (one each) were recovered from remaining three accused persons. This resulted in lodgement of FIR no.50/2020. On conclusion of investigation challan was presented before Designated Court, Baramulla.
4. Applicants are well within their rights to move bail application before court below, which would be considered on its own merits and, as such, there was no occasion for applicant to make instant application, which is, accordingly, dismissed.
