3. Delay in filing the counter affidavit is condoned. Counter affidavit filed by the State is taken on record. Delay condonation application (IA/2/2025) made therefor, is allowed.
4. By means of the present criminal writ petition, petitioner has challenged the FIR No.1 of 2022 dated 25.06.2022 registered with P.S. Rajaswa Police Police Sewa Sagneti, District Almora, under Sections 8, 20, 29 and 60 of the N.D.P.S. Act.
5. It is contended by the learned State Counsel that after investigation, charge-sheet has already been submitted by the police on 28.12.2024 against the petitioner, therefore, nothing remains to be decided in this writ petition and it becomes infructuous.
6. In view of the statement made by learned State Counsel, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioner to challenge the charge-sheet in appropriate proceedings, before the appropriate forum.
7. Interim
order dated 29.11.2024 stands vacated.
