Heard Mr. I H Laskar, the learned counsel appearing for the petitioner. Also heard Mr. K K Parasor, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 482 of the BNSS, 2023, whereby the
Page No.# 2/2 petitioner, namely, Taher Ali has prayed for grant of pre-arrest bail in respect of Dhubri P.S. Case No. 90/2025.
3. On the day of occurrence a truck was carrying two numbers of cows and one calf and one buffalo with a calf. Police suspected that those animals were being smuggled to Bangladesh.
4. The learned counsel for the petitioner has submitted that the petitioner is the owner of those animals and he purchased those on his own. On the basis of the statement given before the Court, the Court of the learned Chief Judicial Magistrate, Dhubri has given the custody of those animals to the petitioner. It appears that the driver of the vehicle could not show the relevant documents to prove that the same belongs to him, therefore, the Court gave the custody of those animals to the petitioner.
5. Under the given circumstances, this Court is of the opinion that the petitioner does not deserve to be detained in custody.
6. Therefore, the bail application of the petitioner is allowed.
7. It is hereby directed that in the event of arrest in connection with Dhubri P.S. Case No. 90/2025, the petitioner, Taher Ali shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority. With the aforesaid direction, the anticipatory bail application stands disposed of. The CD shall be returned. JUDGE Comparing Assistant
