Criminal Miscellaneous Bail Application No. 4320/2025 Amit Kumar S/o Adesh Kumar, Aged About 23 Years, R/o Village Bara Surajpur, Post Jamwara, Police Station Bhogaon, District Mainpuri, Uttar Pradesh. (At Present Confined In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Gajveer Singh Rajawat, Advocate. For Respondent(s) : Mr. J. S. Rathore, PP. HON'BLE MR. JUSTICE ANAND SHARMA (V.J) Order 12/06/2025 1. This bail application has been filed by the accused-petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in respect of FIR No.514/2024 registered at Police Station Sanganer, District Jaipur City (East) for the offences punishable under Sections 137(2) and 96 of BNS. 2. Learned counsel for the accused-petitioner would submit that the accused-petitioner has falsely been implicated in the present FIR, whereas no offence whatsoever has been committed by him. Learned counsel has also pointed out that the prosecutrix herself in her statement under Section 183 BNSS has stated that she intended to go with the accused-petitioner and has denied commission of any crime whatsoever with her. [2025:RJ-JP:23117] (2 of 3) [CRLMB-4320/2025] 3. Learned counsel would further submit that in view of statement under Section 183 BNSS made by prosecutrix, there is no likelihood of conviction. Hence, it is not fruitful to continue his custody. He is behind the bars since 29.12.2024. Trial is likely to take considerable time. Therefore, counsel for the accused- petitioner prayed for allowing the present bail application. 4. Learned Public Prosecutor has vehemently opposed this bail application. 5. Considered the submissions made at Bar. 6. Taking into consideration, the overall facts and circumstances of the case, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail. 7. Accordingly, this bail application is hereby allowed. The accused-petitioner Amit Kumar S/o Adesh Kumar shall be released on bail in pursuance of FIR No.514/2024 registered at Police Station Sanganer, District Jaipur City (East) on furnishing a personal bond in the sum of Rs.1,00,000/- with two sureties of the like amount. That apart, the accused-petitioner shall also follow the conditions as under:- (i) He shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) He shall not leave the country without prior permission of the Court. (iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court. [2025:RJ-JP:23117] (3 of 3) [CRLMB-4320/2025] 8. In case of failure of observance of these conditions, a ground for cancellation of bail would arise. (Anand Sharma (V.J.)),J Tushar/49
