Mr. B.P. Nautiyal, learned Senior Counsel, assisted by Mr. Manokam Nautiyal, learned counsel for the petitioner.
2. Ms. Ruchika Negi, learned counsel, holding brief of Mr. Sandeep Kothari, learned counsel for the respondent.
3. Petitioner is aggrieved by an order of demolition passed by Secretary, District Level Development Authority, Nainital. The said order was passed on 27.12.2024.
4. Since the
order passed by Secretary, impugned in this writ petition, is appealable under Section 27(2) of Uttarakhand Urban and Country Planning and Development Act, 1973, therefore, the writ petition is disposed of with liberty to petitioner to approach the appellate forum. If petitioner files appeal along with Interim Relief Application, within two weeks from today, the Appellate Authority shall consider the Interim Relief Application, within eight weeks from the date of its filing.
5. Till disposal of the Interim Relief Application, status quo shall be maintained qua the construction in question.
