HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CM(5616/2025) in WP(C) 2988/2023 GHULAM AHMAD SHEIKH AND ORS. …Petitioner(s) Through: Mr. Shoaib Hussain, Advocate. VERSUS UNION TERRITORY OF J AND K AND ORS. Through: None. …Respondent(s) CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE. ORDER 07.10.2025 01. No good ground has been made out for the restoration of the writ petition which was dismissed on account of default in the appearance of counsel for the petitioners on 01.09.2025. In the writ case, 110 petitioners were represented by two counsel, both of whom defaulted for last three consecutive dates of hearing, thereby constraining this Court to dismiss the writ petition on 01.09.2025. 02. In the restoration application i.e. CM No. 5616/2025, the explanation pleaded is that one of two counsel, without naming which one, was held up in 01 Regular a traffic jam arriving late to attend the case by which time it stood dismissed for default. Nothing can be more frivolous than this plea in seeking restoration of the writ petition. Additionally, there is an apparent dissimilarity between the signatures of the applicant- Ghulam Mohammad Sheikh, the petitioner No. 1 in the affidavit filed in support of the application and his signatures on the affidavit in support of the writ petition, meaning thereby the application is nothing but an attempt to take this Court for a ride without any seriousness on the part either of the counsel or the applicants. 03. Dismissed. (Rahul Bharti) Judge SRINAGAR 07.10.2025 Bisma Jan.
