Present petition has been filed with the following prayer: "(i) Issue a writ, order or direction in the nature of mandamus commanding opposite party No.3 to remove the illegal encroachment over land agriculture as gata Nos 51, 53, 54, 60, 62, 63,65, 67, 69, 71, 73, 74 and 74Ka, Kha and Gha measuring its area 33.541 hectarerecords as category छ (Chha) land and recorded as river of Village Nauvapur, Revenue situated at Village Dihua Khurd, Pargana Srinagar, Tehsil Kahimpur, District Lakhimpur Kheri, within a stipulated period." 2. Learned Standing Counsel, based upon instructions, states that on certain gatas, possession have already been obtained and the encroachers have been removed, however, with regard to the others, he states that crops are standing thereon and action shall be taken in accordance with law very soon. 3. In view of the said, present petition is disposed off with direction to take appropriate action expeditiously as is proposed by the State in accordance with law after the crop season comes to an end.
