Tiwari, Addl.P.P ------ Order No.02 Dated-25-06-2025 Heard the parties. The petitioner has been made accused in connection with Jadugora P.S. Case No.72 of 2024 corresponding to G.R. Case No.42 of 2025 (S.T. Case No.117 of 2025) registered for the offence punishable under Sections 103(1), 238, 3(5) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons committed murder of Pushpa and Pratibha Das and caused disappearance of the evidence of murder by throwing the dead bodies in the river. It is next submitted that the allegation against the petitioner is false. It is then submitted that though the petitioner is not named in the FIR yet he has been implicated in this case only on the basis of confessional statement of Raju Pandey; as per which the murder of the deceased was committed by Dina Kant Thakur and Mithlesh Thakur. It is then submitted that the only allegation against the petitioner is of throwing the dead bodies of the deceased in the river to destroy the evidence, which offence is bailable in nature. It is then submitted that charge-sheet has been submitted in this case. It is then submitted that the petitioner has been in custody since 11.01.2025 as is evident from para-23 of the instant bail application. It is further submitted that the petitioner has no criminal antecedent as mentioned in para-27 of the instant bail application. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 19.06.2025 passed in B.A. No.4809 of 2025. It is lastly submitted that the petitioner undertakes to co- operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned counsel appearing for the State opposes the prayer for bail of the petitioner. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Ghatshila in connection with Jadugora P.S. Case No.72 of 2024 corresponding to G.R. Case No.42 of 2025 (S.T. Case No.117 of 2025) with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
