1. Heard Shri Syed Tamjeed Ahmad, learned counsel for the applicant and Shri Jayant Singh Tomar, learned A.G.A.-I.
2. The instant application has been filed seeking release of the applicant on bail in Case Crime No.0264 of 2022, under Sections 120B, 409, 420, 427, 467, 468, 471 of IPC, registered at Police Station - Kotwali Nagar, District - Sultanpur. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 21.03.2022 against five persons, not including the applicant, stating that the informant has made some investment in Shine City but no benefit was given on the investments and the company duped the complainant. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case merely because he was the Director of the company till December 2018 and the applicant is in jail since 31.01.2025. The applicant's involvement in 3 other cases of similar nature have been disclosed in para 20 of the affidavit. 5. The learned counsel for the applicant has submitted that two co-accused persons, namely Vinay Kumar and Abdul Hak, who
were also the Diretors of the company, have already been granted bail by means of an order dated 21.05.2025 and 30.07.2025 passed by the Co-ordinate Bench of this Court in CRIMINAL MISC. BAIL APPLICATION Nos. - 3987 of 2025 and 3876 of 2025. 6. The learned A.G.A. has opposed the bail application but he could not dispute the fact that the role assigned to the applicant is similar to the role assigned to two co-accused persons who have already been granted bail. 7. Having considered the aforesaid facts and circumstances of the case, I am of the view that the applicant is also entitled to be released on the ground of parity. 8. Accordingly, this bail application stands allowed. 9.
