By the present writ petition, the petitioner who is owner of the land bearing Khasra No.136 and 160, area 0.5300 and 0.8700 hectare respectively, situated at village Pewari, Patwari Halka No.12, Revenue Circle Kewati, Tahsil Bhanupratappur, Ditrict: Uttar Bastar Kanker seeking a direction towards the respondents for payment of compensation in accordance with the Land Acquisition Act towards the land which is being used for construction of road widening of Rajnandgaon - Bailadila by the State Government. 2. Learned counsel for the petitioner submits that as per demarcation report, the aforesaid agricultural land of the petitioner has been acquired for the purpose of construction of road, without following the provision of Land Acquisition Act, 2013. He would further submit that the petitioner approached many times to the concerned authorities, but the compensation has not be paid to the petitioner till date. 3. Learned counsel for the State, on instruction, placed the proceeding initiated by the Collector for acquisition of the land which are coming within the said road where the land of the petitioner is also included and the proceeding under the Act, 2013 has already been initiated. He would further submits that as the Land Acquisition proceeding has already been initiated, the petitioner will be compensated in accordance with the Act, 3 2013. 4. I have heard learned counsel of the parties and perused the proceeding initiated by the Collector, in which, the land of the petitioner has already been included. 5. In view of the submission made by learned counsel for the State and as the land of the petitioner has already been included in the land acquisition proceeding, writ petition is disposed of.
