The present application has been filed challenging the order dated 26.07.2024 passed by the Additional Sessions Judge, Court No. 1, District Pratapgarh in Criminal Revision No. 02 of 2024 (Kamla Devi Vs. State of U.P. And Others) remanding back the matter to the concerned Magistrate for re-hearing the proceedings registered under Section 133 CrPC. The order dated 26.07.2024 is a mere remand order and and it is not a case to take cognizance under Section 482 CrPC as considering the legality of the remand order does not further the interest of justice. Accordingly, the application is dismissed. However, it is expected that the executive Magistrate shall make all endeavors to dispose of the matter remanded back to him, expeditiously, preferably within a period of three months.
