GP FOR SERVICES I 2 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to pass an order(s) or direction more particularly one in the nature of Mandamus declaring the action of the Respondent No.4 in issuing show cause notice dated 31.07.2024 and not considering the explanation of the Petitioner dated 07.08.2024 thereby restricting the Petitioner to perform her duties and putting the Petitioner in predicament as being illegal, arbitrary, violative to the cardinal principles of natural justice and fundamental rights enshrined under Article 19 and 21 of the Indian Constitution and consequently, set aside the show cause notice dated 31.07.2024 thereby allowing the Petitioner to perform her duties diligently by paying her all the dues and arrears and pass such other order or orders.…” 2. Heard K.Devasri Roshan, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I for respondent No.1, Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent Nos.2 and 3 and Smt B.V.Aparna Lakshmi learned Standing Counsel for respondent No.4. 3. The petitioner was appointed as a Field Assistant on contract basis in the year 2009 and was assigned to work at Minagallu Gram Panchayat, Ananthasagaram Mandal, and has been discharging duties to the best of satisfaction. She was issued show cause notice dated 31.07.2024, by the 4th respondent on certain allegations. The petitioner has submitted detailed explanation on 07.08.2024 refuting the said allegations or irregularities. Thereafter, nothing has 3 transpired and the matter lies so. The petitioner is being under the guise of inquiry, is now prevented from attending her duties. 4. Learned counsel for the petitioner submits that despite submitting the explanation, no further inquiry has taken place. In view of the same, the petitioner cannot be prevented from attending the duties. 5. Sri M.S.R.Chandra Murthy, learned Standing Counsel, on instructions submits that 4th respondent has issued show cause notice and called for explanation. Thereafter, the petitioner has submitted explanation. Upon considering the same, the 4th respondent has to submit a report to 3rd respondent, who is competent to take further action, so far, no such report has been submitted by the 4th respondent. 6. In view of the aforesaid submissions, as there is no order as such passed, on any of the alleged irregularities fixing the petitioner responsible and proposing any disciplinary action, the respondents cannot prevent petitioner from discharging duties. 7. For the aforesaid reasons, the Writ Petition is disposed of, directing the respondents to allow the petitioner to perform duties as Field Assistant, in the place where she is working. This, however, shall not preclude the respondents from proceeding with the ongoing 4 inquiry, which shall be conducted in due process of law. There shall be no order as to costs.
