Neutral Citation No. - 2025:AHC-LKO:19171 Court No. - 18 Case :- WRIT - A No. - 3539 of 2025 Petitioner :- Kajal Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And Another Counsel for Petitioner :- Subhash Chandra Yadav Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and Ms. Deepshikha, learned Chief Standing Counsel for the respondents. The petition has been filed with the following main prayer:- "it is most respectfully prayed that this Hon'ble Court may graciously be pleased to issue a writ, order or direction in the nature of certiorari quashing the final result dated 13.3.2025 of the selection for the post of Constable Civil Police (Male/Female) 2023 in pursuance of the advertisement dated 23.12.2023 to the extent whereby the petitioner has been declared "not selected" in EWS (Female) Category. Learned Chief Standing Counsel while inviting the attention of the Court towards the advertisement dated 23.12.2023, contained in Annexure No. 2 has submitted that as per Clause 6(1) and (2) of the said advertisement, after submission of the application form and uploading the same on the website, the applicant was permitted, if required, to make corrections in the particulars (except mobile number, e-mail ID, and Aadhaar number) before the last date of submission, after payment of the prescribed fee. However, no correction or modification in the particulars of the application will be entertained by the Board after the expiry of the last date. It has been further submitted that the last date for making corrections has already passed, and the final result for the post of Constable Civil Police 2023, pursuant to the advertisement dated 23.12.2023, has been declared on 13.03.2025, wherein the petitioner has been declared 'not selected'. Therefore, having participated in the selection process under the terms of the advertisement and having been declared unsuccessful, now the petitioner cannot be permitted to challenge the terms and conditions of the selection process. Perused the record. The submission advanced by the learned Chief Standing Counsel appears to have force in view of the settled law. Once a candidate participates in a selection process in accordance with the terms of the advertisement, he cannot subsequently challenge the selection process or the procedure adopted therein. Admittedly, the petitioner had an opportunity to make necessary corrections in his application details, as per the advertisement, but he failed to do so within the stipulated time. After the cut-off date, the petitioner has no right to seek any modification. Accordingly, the petition being devoid of merit is hereby dismissed. Order Date :- 5.4.2025 R.C.
