1. Mr. Shishir Dixit, learned counsel appearing for the petitioner would submit that the respondents have already made payment of revised estimate. Mr. Shishir Dixit would further submit that the balance payment according to revise estimate has already been made by the respondents, but earnest amount has not been refunded. 2 submit that the petitioner may be permitted to make a representation before the respondent authorities and the competent authority may be
directed to decide the representation for refund of earnest amount.
2. On the other hand, Mr. Prateek Tiwari, learned Panel Lawyer appearing for the State/respondents would oppose.
3. Heard learned counsel for the parties.
4. Taking into consideration the limited prayer made by Mr. Shishir Dixit, this petition, at this juncture, is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No. 3 for refund of earnest amount and in turn, the authority concerned is
directed to decide the said application preferably within a period of 90 days.
5. With the aforesaid observation(s)/direction(s), the petition is disposed of at motion stage. Sd/-
