PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/A1 to A4, seeking regular bail, in Crime No.313 of 2024 of Devarapalli Police Station, East Godavari District. 2. A case has been registered against the petitioners herein for the offences punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 2 3. The brief facts of the case are that on 23.11.2024 at about 7.00 a.m., on credible information about transporation of ganja, the SI of police along with staff and mediators reached the scene of offence and caught hold of A1 to A4 and searched them in the presence of mediators and seized kg.40.550 grams ganja and arrested A1 to A4 and registered the case. 4. Heard. Perused the record. 5. Learned counsel for the petitioners/A1 to A4 contends that the petitioners is arrested on 23.11.2024 and since they have been languishing in jail and most of the investigation completed and prays to allow the petition. 6. Learned Assistant Public Prosecutor submits that kg 40.550 grams ganja is commercial quantity and investigation is not completed and some more witnesses are to be examined and prays to dismiss the criminal petition. 7. After careful observation of the material on record and submissions made on behalf of both sides, as the contraband involved in this crime is huge quantity i.e. kg 40.550 grams and as the petitioners are remanded to judicial custody on 23.11.2025 itself and the allegations made against the 3 petitioners are grave in nature, this Court is not inclined to consider the criminal petition at this stage. 8.
