Page No.# 2/2 This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Islam Khan, who is apprehending his arrest in connection with Dhubri P.S. Case No. 42/2025 (corresponding to G.R. No.137/2025) under Sections 318(3)/64(1)/308(2) of BNS R/W Section 67(A) of IT Act. The allegation against the accused is that the informant is the sister-in-law of the accused and they were in a relationship, in course of which, they had sexual intercourse and the accused person made objectionable photos and videos of the informant and also blackmail her demanding Rs. 5,00,000/- and upon the failure to pay, he circulated the video-graphed materials through whatsapp and also sent it to the husband of the informant as well as her relative and many other persons. On perusal of the case diary, I find sufficient incriminating materials against the accused and considering the same as well as the nature of the allegations, I do not consider it is a fit case for grant of pre-arrest bail to the petitioner.
