By way of this writ petition, the petitioner has prayed for the following relief:-
“That the present writ petition may kindly be allowed and the judgments passed by the SDO Civil Joginder Nagar and learned Divisional Commissioner Mandi be quashed and set aside being arbitrary, unlawful and without relying upon the relevant record and evidence place by the present petitioner as well as without having appreciated the report of the spot prepared by the local Commissioner.”

When the case was taken up for consideration today, the Court stands apprised that there were other similar matters, which were filed before this Court and on account of the adjudication thereupon and also in lieu of the subsequent events, the matter has to be heard afresh by Divisional Commissioner, Mandi, H.P.

In the light of the submissions so made by learned counsel for the parties, this petition is disposed of by setting aside the order passed by Divisional Commissioner, Mandi, H.P., dated 06.05.20214 and the matter is remanded back to Divisional Commissioner, Mandi, H.P, for adjudication afresh in accordance with law. Pending miscellaneous applications, if any, also stand disposed of.
