1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The petitioner was arraigned as Accused in Crime No.246 of 2024 of Visakhapatnam I Town Police Station, Visakhapatnam Commissionerate, registered for the alleged offences under Sections 352, 353(1)(c), 196(1) of the Bharatiya Nyaya Sanhita, and Sections 66 and 67 of the Information Technology Act, 2000-2008.
3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted some abusive content on the social media platform, i.e., Facebook, against political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Visakhapatnam I Town Police Station, Visakhapatnam Commissionerate, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya
3 CRL.P. No.3471 of 2025 Nagarik Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.246 of 2024.
5. Accordingly, the criminal petition is disposed off.
