The petitioner's grievance is that the inquiry officer to hold the preliminary inquiry in terms of the U.P. Panchayati Raj Act, 1997 has been illegally appointed. The officer appointed is Deputy Commissioner Shwatah Rojgar Yojana, however, learned Standing Counsel for the State has invited out attention to serial No.8 of the list of inquiry officers annexed with the Government Order dated 14.08.2019 wherein Deputy Commissioner Rashtriya Gramin Aajivika Mission is mentioned as one of the officers, who can be appointed to conduct the preliminary inquiry. According to her, the said officer is also the Deputy Commissioner Shwatah Rojgar Yojana and therefore, he being a District Level Officer is competent to be so appointed. In any case, it is informed that the District Magistrate has taken a decision dated 28.02.2025 on the inquiry report submitted by the said officer, a copy of the same has been placed before us, which is taken on record and a copy of the same is also provided to learned Counsel for the petitioner. If aggrieved and if the petitioner has locus, he may avail other remedies prescribed in law. 3. With the aforesaid observations, the writ petition is disposed of. (Om Prakash Shukla, J.)
