GP FOR ENDOWMENTS (AP) The Court made the following: ORDER This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “…. to issue a Writ, Order or Direction,more Particularly one in the nature of Writ of Mandamus declaring the action of the third respondent in issuing restriction letter for not withdrawing the petitioner’s Charities Savings Accounts funds as illegal…..” 2 2. The case of the petitioner in brief is that the petitioner’s Charities Association has established on 22.10.1920. Its main intention is to provide food, education and shelter to poor people. The said Charities Association is maintained by Arya Vysya Community and the petitioner is its Founder Family Member. The trust is running with its own funds and the 3rd respondent has no right to interfere in respect of Charities Administration and Financial issues.Eventhough, the 3rd respondenthas no right to interfere in respect of Charities Administration and Financial issues, he has issued the restriction letter to their bankers in withdrawing the funds from the said Charities Association. Hence the present writ petition is filed. 3. Heard the learned counsel appearing for the petitioner(s) and the learned Government Pleader for Endowments appearing for the respondents. 4. On hearing, learned counsel for the petitioner(s) submits that during the pendency of the writ petition, the writ petitioner was passed away and an implead petition was filed to implead the proposed petitioner as petitioner No.2. During the pendency of the implead petition also, basing on the directions of the 2nd respondent, the 4th respondent issued proceedings dated 12.01.2021. 5. As seen from the impugned proceedings, wherein, at last para,it was mentioned as under: “Dr.Jwala Chaitanya, who is recognized/appointed as member of Founder Family and Secretary to Sri Yadalla Pitchaiah Chetty Charities Association, Kadapa town, YSR Kadapa District is requested to make all correspondence 3 to the concerned Endowments officers in respect of day to day administration and management of the subject institution as per the provisions of the Act 30 of 1987”. 6. In view of the above, learned counsel for the petitioner(s) submits that nothing survives in the present writ petition for further adjudication at this stage and the same may be closed. Recording the said submissions, this Writ Petition is closed. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed. _________________________ DR. K.
