Heard Mrs. Ruhi Siddiqui, learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Vinod Kumar Shukla, Advocate who has filed 'Vakalatnama' on behalf of opposite party no. 3, same is taken on record. By means of this petition the petitioner has prayed following relief : "I. Issue a writ order or direction in the nature of the mandamus opposite party no. 1 and 4 to pay the scale of thereby commanding/directing Executive Engineer from the date of Notional Promotion i.e. 27.06.2001 and refix the pay scale of petitioner from the date of 27.06.2021, in the interest of justice. II. Issue a writ order or direction in the nature of mandamus thereby commanding/directing the opposite parties to grant the IIIrd ACP Notional Promotion from the date when petitioner has completed his 26 years of service at from the date he paid the pay scale of Rs. 7600-39100/- grade pay of Rs. 7600/-, and from January, 2014 to scale of 37400- 67000pay grade of 8700/-, in the interest of justice. III. Issue a writ order or direction in the nature of mandamus thereby also commanding/directing the opposite parties to refix the pay scale of petitioner in according to that Notional Promotion pay scale and pay the differences in pay scale as well as consequential benefit to the petitioner, in the interest of justice. IV. Issue a writ order or direction in the nature of mandamus thereby also commanding/directing the opposite parties to refix the pension also and the differences from the date of refixation be also paid to the petitioner, in the interest of justice." Learned counsel for the petitioner has submitted that ends of justice would suffice if he is allowed to move a fresh representation before the opposite party nos. 1 & 4 and the same may be directed to dispose it of with speaking and reasoned order within stipulated time. With the consent of parties the writ petition is disposed of finally at the admission stage. Without entering into the merits of the issue, the petitioner is permitted to move a fresh representation within 15 days before the opposite party nos. 1 & 4 i.e. Principal Secretary, Urban Development Department, Govt. Of U.P., Lucknow and Secretary, Urban Development Department, Anubhag- 4, Secretariat, Lucknow taking all his pleas and grounds and enclosing his earlier representations along with all relevant documents. If such a representation is moved the opposite party concerned is directed to dispose of the representation of the petitioner with speaking and reasoned order after affording an opportunity of hearing to the parties concerned, strictly in accordance with law expeditiously, say within a period of eight weeks from the date of production of the certified copy of this order. The decision on the representation shall be communicated to the petitioner forthwith. Writ petition is finally disposed of. .
