Neutral Citation No. - 2025:AHC-LKO:18532 Court No. - 8 Case :- WRIT - A No. - 3535 of 2025 Petitioner :- Karunesh Kumar And Another Respondent :- State Of U.P. Thru. Prin. Secy. Forest Deptt. Lko And Another Counsel for Petitioner :- Prem Chandra Chauhan,Kashi Ram Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioners. Notice on behalf of respondent nos.1 and 2 has been accepted by the office of Chief Standing counsel. By means of the instant petition, the petitioners seek direction in the nature of mandamus commanding the respondent to pay minimum of payscale as given to similarly situated persons. It is also urged that the petitioners have already raised their grievances before the respondent no.2 by moving a representation, a copy of which has been brought on record as Annexure no.7, however, the same has yet not been decided. Considering the submissions made and from a perusal of the material on record, this Court is of the opinion that no gainful purpose would be served in keeping the writ petition pending, in as much as, the grievance raised by the petitioners requires consideration of factual aspects which can be considered by respondent no.2 who is already seized of the representation as stated by the petitioners. Considering the aforesaid facts and circumstances, the petition is disposed of with a direction to the respondent no.2/Divisional Director of Forest to consider and decide the pending representation of the petitioners preferably within a period of four weeks from the date a copy of this order is placed before the authority concerned. It is made clear that the Court has not examined the case of either of the parties on merits. The concerned authority shall consider and decide the same by passing a reasoned and speaking order strictly in accordance in with law. With the aforesaid, the petition is disposed of.
