Also heard Mr. R J Baruah, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 in respect of Jamunamukh Police Station Case No.12/2025. 3. Pursuant to the interim order granted earlier, the petitioner H Biswajit Singha has already appeared before the Investigating Officer and his statement has already been recorded. Page No.# 2/2 4. Mr. Baruah submits that there is no report from the Investigating Officer as to whether custodial interrogation is necessary or not. 5. I have considered the submissions made by the learned counsel of both sides. 6. Considering the aforesaid circumstances, this Court is of the opinion that since the petitioner has been co-operating with the police investigation, he does not deserve to be detained in custody. 7. Therefore, the bail application of the petitioner is allowed. 8. The interim bail granted by the Court on 28.05.2025 in favour of the petitioner H Biswajit Singha is hereby made absolute. He shall continue to co-operate with the Investigating Officer. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned. JUDGE Comparing Assistant
