PUBLIC PROSECUTOR The Court made the following Order: Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner is arraigned as accused in C.C.No.351 of 2021. It is submitted that the warrant was issued against the petitioner on 26.07.2024 and Crl.M.P.No.18 of 2025 was filed to recall the warrant. The learned Magistrate has dismissed the 2 petition by observing that the petitioner had intentionally disobeyed the orders of the Court and, as such denied granting relief of recall of warrant. It is also recorded in the order that the matter was posted for accused’s examination on 06.07.2022 and the petitioner was repeatedly not appearing in the Court. That apart, the petitioner did not appeared in the Court personally while submitting his petition under Section 70(2) of Cr.P.C. On these grounds, the petition was dismissed. 3. Considering the same, this Court deems it appropriate to direct the petitioner to file a fresh application and also appear before the learned Magistrate, seeking recall of the Non-Bailable Warrant issued against him and the learned Magistrate may pass a reasoned order recalling the Non-Bailable Warrant issued against the petitioner by imposing conditions as required for disposal of C.C.No.351 of 2021 on the file of Additional Judicial Magistrate of First Class, Gudur. 4. With these observations, the Criminal Petition is disposed of. 5. As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ JUSTICE HARINATH.N BMS
